The first step in the stepparent adoption process is termination of parental rights. This step takes all legal rights and obligations away from the child's biological parent that is out of the picture. This tends to be the most complex part of the process, as the adoption itself is fairly straightforward.

Typically, a stepparent adoption takes place when one biological parent has removed themselves from the child's life. They have done this voluntarily. Perhaps they have been gone for years. In other cases, they may be in prison.
Sometimes, the biological parent will simply consent to terminating their rights so the adoption can take place. However, this is rare.
